1. About these Terms

This website is operated by Elements US LLC, doing business as Cocktail Elements. In these Terms and Conditions (“Terms”), “Cocktail Elements,” “we,” “us,” and “our” refer to that website operator. “You” and “your” refer to the person using the website or placing an order.

These Terms explain the conditions for using our website and ordering products offered through it. Please read them before placing an order. When you accept these Terms through the website or place an order subject to them, you agree to be bound by them. Do not place an order if you do not agree.

Our Shipping Policy and Return and Refund Policy form part of these Terms. Our Privacy Policy separately explains our personal-information practices and takes priority on questions concerning those practices.

The roles of AccelPay and the retailers fulfilling your order are explained in Section 3. These Terms do not replace the separate agreements applicable to those services and purchases.

2. Eligibility and responsible use

To place an order, you must be legally capable of entering into a binding agreement and provide accurate information about yourself and the intended recipient.

For products subject to alcohol age restrictions, the purchaser and recipient must be at least 21 years old and meet any additional applicable legal requirements. You must not purchase an age-restricted product for an ineligible person or attempt to bypass age or identity verification. These requirements also apply to gifts containing age-restricted products.

Use products according to their labels and instructions, including any storage directions and warnings. Review ingredient and alcohol-content information before use. Contact us before ordering if you need additional product information.

3. Orders through AccelPay and participating retailers

U.S. orders are handled by licensed, independent retailers participating in the AccelPay network. For a purchase through AccelPay, the product-sale agreement is between you and the applicable retailer. AccelPay facilitates the transaction rather than selling the products itself.

Purchases through AccelPay are also subject to the applicable AccelPay Terms of Service, AccelPay Privacy Policy, payment and ecommerce terms, and retailer terms presented for your order. Review those documents before purchasing.

These Terms address your relationship with Cocktail Elements; the separate AccelPay and retailer terms govern their respective services and transactions. Nothing here eliminates any responsibility Cocktail Elements has under applicable law. AccelPay

4. Product information, availability, and pricing

We aim to present accurate product descriptions, images, package quantities, and prices. Products may be updated or discontinued, and availability can depend on the retailer and delivery destination.

Photographs may include drinks, glassware, or props that are not part of the purchase. Refer to the listing for the contents and quantity included. Screen settings may affect how colors appear, but this does not excuse a material difference between the product supplied and its description.

Estimates of sprays or servings per bottle depend on the amount used and are not a guarantee of identical results for every customer.

Unless indicated otherwise, prices are shown in U.S. dollars. Applicable taxes, shipping charges, and other disclosed charges are presented before you submit your order. Promotional offers are subject to the conditions stated with the offer.

We may change prices for future orders. A price change does not authorize an increase to an order already accepted. If a material pricing or listing error affects your order, we or the applicable retailer will contact you to explain the issue and any available correction or cancellation options. We will not substitute a materially different product or increase your charge without your agreement.

5. Ordering and payment

By submitting an order, you confirm that your billing, contact, and delivery information is accurate and that you are authorized to use the selected payment method. You authorize payment of the total disclosed when you place the order.

An order-receipt email acknowledges submission; it does not by itself establish acceptance by the fulfilling retailer. Orders through AccelPay remain subject to the acceptance requirements of AccelPay and the applicable retailer.

An order may be declined or canceled for reasons such as unavailable inventory, an unsupported delivery address, an unsuccessful payment, suspected fraud, or a legal restriction. You will be notified if your order cannot be fulfilled. Any payment collected for canceled, unfulfilled items will be refunded as required by applicable law and the applicable transaction terms.

Please review your order carefully before submitting it. The limits on changes and cancellation requests are described in Section 7 and our Return and Refund Policy.

6. Shipping and delivery

We currently offer delivery to eligible addresses in the continental United States. We cannot ship to PO boxes. Product-specific restrictions and retailer delivery coverage may further limit eligibility.

Our Shipping Policy sets out processing and delivery timeframes, separate-shipment arrangements, delivery attempts, and the fees associated with undeliverable packages and requested reshipments. Please review it before ordering. The policy and order-specific delivery terms presented when you purchase apply to that order.

Orders containing alcohol require an adult signature and an ID check at delivery. You are responsible for providing a correct delivery address and arranging for an eligible adult to receive a shipment when required. Failed delivery may result in the charges disclosed in the Shipping Policy, subject to applicable law.

When a seller cannot ship within the promised time, any legally required delay notice, request for consent to a revised shipment date, and cancellation or refund option must still be provided. Delivery estimates and undeliverable-package provisions do not remove those rights. Federal Trade Commission

7. Order changes, cancellations, returns, and refunds

Orders cannot be edited after they are placed. You may request cancellation before shipment by contacting support@accelpay.io. A request does not guarantee cancellation, except where applicable law gives you a cancellation right.

Orders containing alcohol cannot be returned or exchanged, except where required by law. This does not prevent you from reporting damaged or incorrect items or seeking an applicable remedy.

For a damaged or incorrect shipment, email support@accelpay.io with your order details and a photo of the problem. For damaged orders, the support team will coordinate a reshipment within three business days, as stated in our Return and Refund Policy. This is a coordination timeframe, not a promise of delivery within three business days.

Other refund requests are reviewed on a case-by-case basis under the Return and Refund Policy. A refund required by law is not discretionary. Nothing in these Terms removes applicable rights concerning defective goods, unfulfilled orders, or payment disputes.

Do not send products to our business address or a retailer without receiving return instructions.

8. Accounts and website security

If you create an account, keep your details current and protect your sign-in credentials. Notify us promptly if you suspect unauthorized access.

You may not use our website to commit fraud, impersonate another person, submit unauthorized payment information, distribute malicious software, interfere with the website’s operation, or gain unauthorized access to accounts or systems.

You may not use automated methods to disrupt the website or extract protected information in violation of applicable law. Nothing in this section restricts lawful accessibility tools or activity that cannot legally be prohibited.

9. Intellectual property

The Cocktail Elements branding and the original photographs, videos, designs, and written materials on this website are owned by or used with permission of their respective rights holders.

You may browse the website, purchase products, use our instructions to prepare drinks, and share links to our publicly available pages. Except as permitted by law or authorized by the rights holder, you may not reproduce, sell, or commercially republish protected website materials or use our branding to suggest an endorsement or affiliation.

Purchasing a product does not transfer ownership of any associated trademark or copyright.

10. Reviews and customer submissions

Reviews and other public submissions should reflect your genuine experience. Do not submit unlawful, fraudulent, threatening, or infringing material, another person’s private information, or content that falsely represents a customer experience. Disclose any material relationship or incentive associated with a review where required.

You retain ownership of your submissions. When you submit content for public display on our website, you give us nonexclusive permission to host, display, and format it for that purpose, including through service providers acting on our behalf. This permission does not transfer ownership or permit edits that materially misrepresent your opinion.

We may remove spam, unlawful content, private information, or unrelated submissions. We will not prohibit or penalize an honest review simply because it is negative. Nothing in these Terms restricts your right to share an honest opinion about our products, services, or business. Federal Trade Commission

11. Privacy and communications

Our collection, use, and sharing of personal information are described in our Privacy Policy. AccelPay, participating retailers, and other providers may have separate privacy notices applicable to their activities.

We and the providers involved in your order may send transaction-related communications, such as order confirmations, shipping updates, and responses to support requests.

Marketing communications are subject to the preferences you provide and any consent required by law. Agreeing to these Terms or placing an order does not, by itself, enroll you in marketing text messages or override an unsubscribe request.

12. Shopify and other third-party services

Our online store is hosted on Shopify, which provides ecommerce technology. Shopify’s role as the technology platform does not make it the seller of products purchased from participating retailers through AccelPay.

Our website may also contain third-party tools, payment options, embedded content, or links. Those services may have their own terms and privacy policies. Review them when using those services.

We do not control independent third-party websites. Providing a link does not mean that we endorse everything on the linked website. This section does not exclude any responsibility we have for our own conduct or obligations under applicable law.

13. Website availability and access

We may update website features, correct errors, or temporarily interrupt access for maintenance or security reasons. We may restrict access where reasonably necessary to address fraud, unlawful conduct, security risks, or a material breach of these Terms.

Changes to the website or account access do not remove obligations relating to accepted orders, applicable refunds, or statutory consumer rights.

We will not restrict access merely because you have made a good-faith complaint or posted an honest negative review.

14. Disclaimers and limits of liability

We work to keep the website accurate and functional, but we do not guarantee uninterrupted access or that every technical error will be prevented. To the extent permitted by law, access to the website is provided on an “as available” basis.

This website-access disclaimer does not override product descriptions, express warranties, the obligations in our published policies, or rights that cannot legally be excluded.

To the extent permitted by law, Cocktail Elements is not liable for indirect or consequential losses arising from your use of the website, such as lost business profits caused by a website interruption.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, gross negligence, willful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. These Terms do not limit a remedy that applicable consumer law makes available to you.

15. Disputes and consumer rights

For concerns about Cocktail Elements or these Terms, contact contact@shopcocktailelements.com. For order fulfillment, shipping, cancellation, or refund concerns, contact support@accelpay.io. We encourage you to contact the appropriate support team so the issue can be investigated.

Contacting support is not a prerequisite to exercising a legal right, and it does not extend a legal deadline unless expressly agreed or required by law.

Disputes with Cocktail Elements are subject to applicable law and may be brought before a court with lawful jurisdiction. These Terms do not add a mandatory arbitration requirement or a class-action waiver for disputes with Cocktail Elements.

The separate AccelPay Terms of Service contain their own dispute-resolution provisions, including arbitration and class-action restrictions. This section does not amend those separate terms or determine whether they apply to a particular claim. AccelPay

16. Changes to these Terms and general provisions

We may update these Terms and will identify the latest version by the date above. Changes apply prospectively. We will provide additional notice or obtain agreement when required by law.

A later update does not retroactively change the terms applicable to an order already placed without your agreement, except where a change is required by law.

If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion is not a permanent waiver of it.

These Terms and the policies incorporated into them describe the agreement concerning their subject matter between you and Cocktail Elements. They do not replace separate agreements with AccelPay or participating retailers, or override product-specific promises, express warranties, or rights that applicable law protects.
